Terms of service

These terms govern your use of the Kustos app and website. The short version: your workout data belongs to you, we host it only to run the service, social features come with community rules, and you can export everything and leave whenever you want. Questions? Email support@kustosapp.com.

1. Who we are and what you’re agreeing to

Kustos is operated by Mountain Crest Agency FZCO, a company registered in Dubai, United Arab Emirates (“Kustos”, “we”, “us”). These terms are an agreement between you and us covering the Kustos mobile app for iOS and Android and the kustosapp.com website (together, the “service”). By using the service you accept these terms and our privacy policy. If you don’t agree, please don’t use the service.

2. The service

Kustos is a workout tracker for strength training: set-by-set logging, reusable routines, workout history, progression charts, body measurements, backups, and optional social features for training with friends. It is built offline-first — logging a workout never needs a connection; your sets are saved on your device instantly and backed up when you’re online.

Routines are unlimited and free, and your logged history and its CSV export are never paywalled. We may add, change, or retire features over time; if a change materially reduces what the service does, we’ll say so through the app or this site (see section 11).

3. Accounts and guest mode

Guest mode. You can use Kustos without creating an account — no signup and no personal data are required to start, and no account of any kind is created on our servers until you sign up. The details are in the privacy policy.

Accounts. Creating an account adds backup, restore, and social features. You agree to provide accurate information, keep your credentials confidential, and accept responsibility for activity under your account. Tell us at support@kustosapp.com if you suspect unauthorized access.

Minimum age. You must be at least 13 years old to use Kustos, with or without an account. We do not knowingly collect personal data from children under 13, and we will delete accounts we learn belong to them.

4. Acceptable use

Use Kustos lawfully and fairly. You may not:

• break the law or infringe anyone’s rights while using the service;
• harass, threaten, or deceive other users, or post content that violates the community guidelines;
• probe, disrupt, or overload the service, or attempt to access data or accounts that aren’t yours;
• scrape the service, resell it, or misrepresent an affiliation with Kustos;
• reverse engineer the app except where the law expressly permits it.

The community guidelines are part of these terms and govern everything you share through social features.

5. Your content and your data

Your workout data is yours. You own the workouts, routines, notes, measurements, and everything else you record in Kustos. We claim no ownership of any of it.

Limited hosting license. So the service can work, you grant us a non-exclusive, worldwide, royalty-free license to store, back up, transmit, and display your data — solely to provide the service to you and, where you choose to share something, to the people you share it with. This license ends when you delete the data or your account, except for the short period needed to clear backups and for copies others already received because you shared with them.

Portability. You can export your full workout history and body-weight log as CSV at any time from Settings (“Export & Import Data” → “Export Data”). See how to export your data.

Our content. The Kustos app, brand, design, and exercise catalog belong to us and our licensors. We grant you a personal, non-transferable license to use the app as intended. That license doesn’t touch your data, which remains yours.

6. Shared content

Social features are optional and private by default. When you do share — a finished workout to the feed, a photo, a comment, a profile — the following applies:

Your license to us. You keep ownership of what you share. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content within the service so other users you’ve shared it with can see it. The license ends when you delete the content or your account, subject to the same limited exceptions as in section 5.

Your responsibility. You are responsible for what you share, and you confirm you have the rights to share it. Shared content reflects its author’s views, not ours — Kustos does not endorse, verify, or vouch for any user content, including training advice other users post.

Moderation. We may remove or restrict content, and suspend or terminate accounts, that violate these terms or the community guidelines — without prior notice where the violation is serious or legally requires it. To report content or a user, email support@kustosapp.com — a human reviews every report and acts on violations. If you believe we got a decision wrong, contact support@kustosapp.com and we’ll take a second look.

7. Leaving Kustos: termination and your data on exit

You can leave any time. Stop using the app, or delete your account from Settings (“Delete Account”). Account deletion is permanent and removes your account and its data from our systems. Before you delete, export your history as CSV from Settings (“Export & Import Data”) — deletion cannot be reversed, so take your data with you first. See deleting your account.

We can terminate for cause. We may suspend or terminate your access if you materially violate these terms, if we’re legally required to, or if continuing would put other users or the service at risk. Where lawful and practical, we’ll give you notice and a reasonable opportunity to export your data before your account is closed.

8. Disclaimers

Not medical advice. Kustos is a logging and tracking tool. Nothing in the app or on this site is medical, health, or professional training advice. Consult a qualified professional before starting a training program, especially if you have a medical condition, and stop and seek help if something feels wrong. You train at your own risk, and you are responsible for using safe form, appropriate loads, and equipment you can handle.

As is. The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-interruption. We work hard to protect your data — offline-first logging, versioned backups, CSV export — but no service can promise perfection, which is exactly why we make your data easy to take with you.

9. Limitation of liability

To the maximum extent permitted by law: we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data you failed to export when given the opportunity, or personal injury arising from your training decisions. Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim and 50 USD. Nothing in these terms limits liability that cannot be limited by law, and nothing removes rights you hold as a consumer under mandatory local law.

10. Governing law

These terms are governed by the laws of the United Arab Emirates, and disputes will be resolved in the courts of Dubai, United Arab Emirates, except where mandatory consumer-protection law gives you the right to your local courts and law.

11. Changes to these terms

We may update these terms as the service evolves. When we do, we’ll update the date at the top of this page and record the change in the changelog below. For material changes we’ll give advance notice through the app or this site before the new terms take effect. If you keep using Kustos after a change takes effect, that means you accept the updated terms; if you don’t accept them, export your data and stop using the service before the effective date.
